Article 2
Products
Onyx Forged designs and sells high-end custom forged wheels intended for exceptional motor vehicles.
The products are manufactured individually according to the precise specifications validated by the Customer (dimensions, finish, design, offset, customisation options).
Where needed, Onyx Forged may entrust all or part of the manufacture of the wheels to European or other partner production workshops. The wheels are then manufactured according to the specifications validated by the Customer, without any change to the characteristics of the order, its price or its lead times and at no additional cost to the Customer; Onyx Forged remains solely responsible to the Customer for the proper performance of the order (article L221-15 of the French Consumer Code), for the conformity of the wheels and for the warranties of article 6, within the limits of article 7.1 for a business Customer.
The essential characteristics of the products are presented on the product page of the Site or in the personalised quotation sent to the Customer, before any order.
Colours. The colours shown on the Site, on any other sales channel of Onyx Forged and at payment (swatches, visuals, thumbnails, previews) are indicative: their rendering depends on the screen, the lighting and the surface finish. The colour manufactured is the one designated by the order summary: the colour or colours named for each part (colour of the wheel, or colour of the centre and colour of the lip), with the appearance where specified (brushed, gloss, machined face), or, for an “Autre teinte” (other colour), the reference given by the Customer, under the conditions of article 3.1. Where the order bears the mention “Teinte sur mesure” (custom colour) without naming a colour, the colour manufactured is the one the Customer chooses under the conditions of article 3.1. Where the summary also bears the name of a catalogue finish and that name differs from the named colours, it is the named colours that designate what is manufactured: they describe the visual of that finish on the product page, the name of the finish serving only to identify the variant. Variations in rendering due to the screen, the lighting or the surface finish do not, in themselves, constitute a lack of conformity.
Article 3
Order
3.1 Confirmation of the order
The order becomes firm and final after:
- Validation by the Customer of the technical specifications (dimensions, model, finish or colours)
- Acceptance of these Terms and Conditions
- Payment of the full price (direct purchase on the Site) or of the deposit (order on personalised quotation), as provided for in article 4.2
For a direct purchase on the Site, the configuration chosen by the Customer and summarised before payment constitutes validation of the technical specifications; for an order on quotation, this validation results from the acceptance of the quotation. The order is therefore firm as soon as payment is made. If our design office then confirms the measurements of the vehicle with the Customer, before the order is transmitted to production (article 3.3), this confirmation specifies how the order is performed without deferring its firm nature; the time limit of article 5.1 then runs at the earliest from the Customer's reply giving approval of those measurements, including those that express the wheel position (next paragraph), under the conditions of that article. If the Customer does not reply within 30 days of a written reminder from Onyx Forged, the order is terminated by operation of law and the sums paid are refunded to the Customer in full within 14 days of that termination.
The wheel position chosen by the Customer (“Comme à l'origine” (as on the original wheels), “Plus sorties” (further out), “Au ras de l'aile” (flush with the wheel arch)) expresses a wish as to appearance, with no figure attached. Our design office translates it into an offset (ET) and, unless the order or the quotation already sets the width, into a width, calculated for the vehicle as described by the Customer; it submits these measurements to the Customer before any transmission to production. Once accepted by the Customer, these measurements form part of the validated specifications and alone designate what is manufactured as regards the wheel position, without prejudice to the statutory guarantees of article 6.4 or to the liability of Onyx Forged where these measurements result from an error by its design office with regard to the vehicle as so described. If the desired position cannot be achieved, the paragraph of article 3.3 on a configuration that cannot be fitted applies.
Settings chosen by our experts. Where the order summary bears the mention “Réglages : Choisis par nos experts” (settings: chosen by our experts), the Customer entrusts our design office with the choice of the width, the offset (ET), the wheel position and the profile of the face for the vehicle the Customer has described, as well as with checking the diameter ordered, which is the one the Customer selected at the displayed price. The design office submits them to the Customer in writing before any transmission to production. If it advises a different diameter, it proposes it with the price displayed on the Site for that diameter on the date of the order: the Customer may accept it, the difference being refunded to the Customer or paid by the Customer before the transmission to production, or keep the diameter ordered; if that diameter cannot be fitted, the paragraph of article 3.3 on a configuration that cannot be fitted applies, with no compensation on either side. Once accepted by the Customer, these settings form part of the validated specifications and alone designate what is manufactured for these settings, without prejudice to the statutory guarantees of article 6.4 or to Onyx Forged's liability in the event of an error by its design office with regard to the vehicle as so described. The time limit of article 5.1 runs at the earliest from that approval, under the conditions of that article. Until that approval, the Customer may cancel the order in writing (by email to contact@onyxforgedwheels.com): the sums paid are refunded to the Customer in full within 14 days of receipt of the written request, with no compensation. If the Customer does not reply within 30 days of a written reminder from Onyx Forged, the order is terminated by operation of law and the sums paid are refunded to the Customer in full within 14 days of that termination.
The Customer may request a 3D render of the wheels on the vehicle, free of charge, at the latest in the reply to the request for approval of the measurements sent by our design office. This render shows the validated specifications, without changing them. Onyx Forged sends it within 5 working days of the request; the time limit of article 5.1 then runs at the earliest from the Customer's reply approving this render, under the conditions of that article. As this render does not change the validated specifications, the time limit likewise runs from the Customer's reply rejecting it without pointing out any discrepancy between the render and those specifications or, if the Customer does not reply within 30 days of a written reminder from Onyx Forged, from the end of those 30 days; the Customer retains the option to cancel provided for in article 3.3.
A colour designated by a reference from the Customer (“Autre teinte” (other colour): code or name of a colour from a colour chart, such as RAL, or from a car maker, or a description) is ordered on the Site at the price displayed for the chosen diameter, with no supplement; the reference, as it appears in the order summary, forms part of the validated specifications. It designates a single colour per part (that of the wheel, or that of the centre and that of the lip), in a single appearance: the one it specifies (gloss, satin, matt) or, failing that, satin. Any other element of finish (contrasting finishes, machined face, coloured bolts, pattern, effect) is not included in this price, whatever the channel of the order, and is the subject of a separate quotation. Onyx Forged manufactures the colour corresponding to this reference, differences in rendering falling under article 2. Where the reference is a description rather than a code or a colour name from a colour chart or a car maker, where it cannot be reproduced, or where it requires an element of finish not included in this price, Onyx Forged submits to the Customer in writing, before any manufacture, the single colour it adopts from it or, failing that, the closest achievable colour: the Customer may accept it, or cancel the order in writing (by email to contact@onyxforgedwheels.com); the sums paid are then refunded to the Customer in full within 14 days of receipt of the written request, with no compensation. The time limit of article 5.1 runs at the earliest from the Customer's reply accepting the colour submitted, under the conditions of that article. If the Customer does not reply within 30 days of a written reminder from Onyx Forged, the order is terminated by operation of law and the sums paid are refunded to the Customer in full within 14 days of that termination.
Where an order bears the mention “Teinte sur mesure” (custom colour) without designating a colour, whatever the channel through which it was placed (Site, online shop hosted by Shopify, shopping assistant, sale in person), Onyx Forged asks the Customer by email for the colour or colours of their choice (for a two-piece wheel, that of the centre and that of the lip) from the 9 colours of the palette shown on the product pages of the Site, each in its appearance: Chrome (mirror-polished), Anthracite (plain satin), Black (satin, almost matt), Bronze (metallic satin), Gold (champagne tone, gloss), Blue (steel tone, gloss), Orange (gloss candy lacquer), Red (gloss candy lacquer), Pink (satin, fine metallic grain), with no change of price. The colour designated by the Customer is understood in the appearance so indicated, which forms part of the validated specifications. At the displayed price, such an order includes only this choice from the 9 colours of the palette: a free reference is not included (it is ordered on the Site, under the conditions of the previous paragraph), and any other customisation of finish presented as possible on quotation (different appearance, contrasting finishes, coloured bolts) is the subject of a separate quotation. The validation of the technical specifications then results from the Customer's choice of these colours and from the Customer's approval of the measurements of the vehicle submitted by our design office, given together or one after the other; the Customer's reply giving them constitutes acceptance of these Terms and Conditions, the address of which is sent to the Customer with the request for the colour, and makes the order firm and final. The time limit of article 5.1 runs at the earliest from this validation, under the conditions of that article. Until this validation (choice of the colour or colours and approval of the measurements), the Customer may cancel the order in writing (by email to contact@onyxforgedwheels.com): the sums paid are refunded to the Customer in full within 14 days, with no compensation. If the Customer does not reply within 30 days of a written reminder from Onyx Forged, the order is terminated by operation of law and the sums paid are refunded to the Customer in full within the same period. After the validation, articles 3.2 and 3.3 apply.
3.2 Made-to-measure nature and no right of withdrawal
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of goods made to the consumer's specifications or clearly personalised.
As Onyx Forged wheels are made entirely to measure according to the specifications validated by the Customer (each set is machined to order to the measurements of the vehicle: diameter, width, offset, PCD, centre bore, and finished in the chosen colour or colours), no right of withdrawal may be exercised after confirmation of the order.
3.3 Cancellation of the order
The order is firm and final under the conditions of article 3.1. Each party may nevertheless cancel it, in writing (for the Customer, by email to contact@onyxforgedwheels.com), until the order is transmitted to production, on payment of a cancellation fee equal to 30% of the price including VAT of the order, which corresponds to the costs of the technical fitting study and of handling the order, the collection and refund costs not returned to Onyx Forged, and the margin legitimately expected. For a business Customer, this fee is raised to 40% of the price excluding VAT, for each of the parties:
- If the Customer cancels, Onyx Forged keeps this fee out of the sums paid and refunds the balance within 14 days of receipt of the written request, by the means of payment used. For an order on quotation, no instalment still to be paid (article 4.2) remains due.
- If Onyx Forged cancels, it refunds to the Customer all the sums paid and also pays the Customer a fee of the same amount, within 14 days of sending its written notice of cancellation.
The order is transmitted to production, to our manufacturing partner, after the validation of the technical specifications by the Customer (article 3.1) and their checking by our design office. Onyx Forged informs the Customer by an email sent at the time of this transmission. The date and time at which this email is sent are authoritative: a cancellation received by Onyx Forged before it is sent is effective, a cancellation received afterwards is not.
After the transmission to production, and subject to article 7.2 and to the following paragraph, the order can no longer be cancelled, either by the Customer or by Onyx Forged: the contract is performed, the wheels are delivered to the Customer under the conditions of article 5 and the price remains due in full. For an order on quotation, the instalments still due are payable on the dates of article 4.2. If one of them is not paid within 30 days of a formal notice that has remained without effect, Onyx Forged may terminate the sale under the conditions of article 4.5; it then sets off the sums paid against the loss it substantiates (cost of manufacture less the resale value of the wheels, costs incurred, lost margin) and returns any surplus.
If the configuration ordered cannot be fitted to the Customer's vehicle or manufactured, with regard to the vehicle manufacturer's measurements (PCD, centre bore, offset, brake caliper clearance, permissible load), to the wheel arch of the vehicle for the wheel position chosen by the Customer, or to a reasoned refusal by our manufacturing partner, including after the transmission to production, Onyx Forged notifies the Customer by email, giving the technical data on which its decision is based. Unless the Customer accepts the replacement configuration proposed, the order is terminated by operation of law: the sums paid are refunded in full within 14 days, with no compensation on either side, unless the impossibility results from Onyx Forged's error in the configuration it proposed or validated.
This article does not apply where the Customer ends the order because of a failure by Onyx Forged, in particular where the delivery time is exceeded (article 5.1 bis) or in the event of a lack of conformity (article 6.4): these situations are governed by the articles concerned and by the French Consumer Code.
Article 4
Price and payment
4.1 Price
Prices are stated in euros including all taxes, including French VAT at the standard rate of 20%. Onyx Forged is registered for VAT under the EU VAT number FR93105640593. The prices displayed on the Site or stated in personalised quotations are the final price: no amount is added at the time of payment, delivery being free, subject only to the following paragraph for delivery outside the euro area.
Delivery outside the euro area. For delivery to a country whose currency is not the euro, in particular the United Kingdom, Switzerland or Liechtenstein, the payment page shows and charges the price in the currency of that country, converted from the price in euros at the day's exchange rate applied by Shopify Payments, currency conversion charge included. The amount shown on the payment page before the order is confirmed is then the final price, within the meaning of this article and of article 4.2: nothing is added to it by Onyx Forged. Where the delivery is an export outside the European Union, this price does not include French VAT. Duties, import taxes and customs clearance fees charged in the country of delivery fall under article 5.2.
Business Customers registered for VAT recover it under the ordinary rules. The invoice, issued automatically after payment, shows the amount excluding tax, the rate applied and the amount of VAT.
Unit of sale: any price displayed or quoted is for a set of four wheels, i.e. a full set for the vehicle. Onyx Forged does not sell its wheels individually. The word “from” designates the least expensive configuration of the model concerned (entry-level diameter and finish) for this same set of four wheels.
Prices may be revised at any time, but the prices applicable are those in force at the time the order is confirmed.
4.2 Payment schedule
Direct purchase on the Site. The displayed price is paid in a single payment when the order is confirmed. Its receipt starts the delivery time, under the conditions of article 5.1; the order is then transmitted to production under the conditions of article 3.3. No other payment is requested: delivery is free and no charge is added, subject only to the import duties and taxes of article 5.2.
Order on a quotation calculated online. Where the quotation is drawn up at the price of the price grid by the configurator of the Site, the price is paid in three instalments, interest-free:
- 40% when the order is confirmed (deposit). Its receipt starts the delivery time, under the conditions of article 5.1.
- 30%, 10 days after receipt of the deposit.
- 30%, the balance, 21 days after receipt of the deposit.
Onyx Forged requests the second and third instalments by an email sent to the Customer from the scheduled date, on a working day, stating the amount and containing a payment link. Each instalment is payable within 7 days of that email, until the end of the last day. The third is requested only after the second has been paid: if the second is paid after the date scheduled for the third, the third is requested at the earliest on the day after that payment. When instalments are paid on their due dates, no charge, interest or supplement is added: the sum of the three instalments is equal to the price including VAT stated in the quotation. As the price is paid in full before delivery, this payment in instalments does not constitute a credit transaction. The wheels are handed to the carrier only once the price has been received in full.
For example, a set of four wheels at €3,200 including VAT ordered on quotation gives rise to a deposit of €1,280, then to two instalments of €960 and €960. The same set ordered directly on the Site is paid €3,200 on order. In both cases, delivery is free and no charge is added, subject only to the import duties and taxes of article 5.2.
Information only, for delivery to Great Britain (not part of these Terms and Conditions): on 4 October 2026, our checkout charged £2,780 for a set priced €3,200 on this website; UK import VAT (20%) adds £556, so £3,336, before the carrier's clearance fee and any import duty (UK import VAT then applies to the duty too); the amount shown at checkout is the one charged.
If the order ends before its term (article 3.3), no instalment still to be paid remains due.
A quotation drawn up by hand by Onyx Forged, outside the configurator (colour or combination on request, three-piece construction, dimensions outside the price grid), sets out its own payment schedule; failing that, 40% of the price is paid on order and the balance before dispatch. A quotation providing for payment in two instalments (a deposit, then the balance before dispatch) is performed according to its terms: its balance is payable only when the wheels are handed to the carrier, which it precedes. Onyx Forged may invite the Customer to pay it earlier, without that invitation bringing forward the date on which it is payable.
The Customer is informed of the exact amount of each payment when the quotation is drawn up or the configuration is made on the Site, before any commitment.
4.3 Accepted means of payment
Payment is made online by bank card (Visa, Mastercard, American Express), including by Apple Pay on compatible devices. Depending on the country of delivery, the payment page may also offer other means of payment, in particular Klarna, Bancontact or bank transfer; the price remains that of article 4.1, and the delivery time runs under the conditions of article 5.1.
The instalments of an order on quotation are paid online, by the payment link attached to the email requesting them. Online payments are secured through the Shopify Payments platform (PCI DSS Level 1 service provider).
4.4 Legal nature of the payment
The payment made by the Customer on order (full price for a direct purchase on the Site, deposit for an order on personalised quotation: 40% for a quotation calculated online, or the one set by the quotation drawn up by hand) firmly binds both parties; it does not constitute “arrhes” (a sum by which either party may withdraw from the contract, the payer by forfeiting it, the recipient by repaying twice its amount) within the meaning of article L214-1 of the French Consumer Code and article 1590 of the French Civil Code: the only option to cancel, and its consequences, are those provided for in article 3.3. The subsequent instalments of an order on quotation are part payments of the price, which are not “arrhes” either.
Consequently, the order is firm and final under the conditions of article 3.1, subject to the provisions of article 3 on made-to-measure orders, on the absence of a right of withdrawal and on cancellation (article 3.3).
4.5 Late payment
Between businesses, any late payment gives rise to late-payment interest at the statutory rate plus 10 points, calculated on the sums due including VAT, and to a fixed recovery indemnity of €40 (article L441-10 of the French Commercial Code). For a consumer Customer, unpaid sums bear interest at the statutory rate from the formal notice.
For an order on quotation, where an instalment is not paid within the time limit of article 4.2, Onyx Forged sends the Customer a reminder by email when that time limit expires, then, where applicable, a second reminder. As long as an instalment that has fallen due remains unpaid, the dispatch of the wheels is suspended, and Onyx Forged may suspend the performance of the order, until payment is made (article 1219 of the French Civil Code); the delivery time of article 5.1 is extended accordingly, without this constituting a failure on its part. The balance of a quotation paid in two instalments (article 4.2) may be the subject of a formal notice only once it is payable.
Termination clause. If an instalment that has fallen due is not paid within 30 days of a formal notice sent by Onyx Forged to the Customer and referring to this clause, Onyx Forged may terminate the sale by operation of law, by written notice to the Customer (article 1225 of the French Civil Code): before the transmission to production, it then keeps the cancellation fee of article 3.3 and returns the surplus of the sums paid; afterwards, it proceeds as provided for in article 3.3 for an order transmitted to production.
Conversely, where the Customer terminates the sale because of a failure by Onyx Forged to meet its obligations (in particular under articles 5.1 bis and 6.4) while the order has not been transmitted to production, Onyx Forged returns the sums paid to the Customer and also pays the Customer a fee equal to the cancellation fee of article 3.3.
Article 5
Manufacturing time and delivery
5.1 Delivery time
The wheels are delivered in 4 to 8 working weeks, i.e. 20 to 40 working days (Monday to Friday, excluding French public holidays), shipping included.
This time runs from receipt of full payment for an order placed directly on the Site, or from receipt of the deposit (40% for a quotation calculated online, or the one set by the quotation drawn up by hand) for an order made on personalised quotation (article 4.2), its subsequent instalments being paid under the conditions of that article. Where the order requires the Customer's approval of the measurements of the vehicle, of a colour or of a 3D render the Customer has requested (article 3.1: approval of the measurements, choice or acceptance of a colour, approval of the render), the time runs at the earliest from that approval. Onyx Forged sends the Customer what their approval is requested on within 5 working days of receipt of the payment or, where these elements are drawn up from a reply by the Customer (vehicle registration document, confirmation of the vehicle, of its brakes, of its suspension and of its bodywork, colour reference, request for a render), within 5 working days of that reply. Failing that, the time runs from the end of that period of 5 working days; waiting for the Customer's reply then only suspends it, like the other cases of suspension provided for in this article.
For a dedicated project whose page, accepted by the Customer when paying for it, sets its own time limits (design renders, manufacture, delivery) and their starting point, those time limits replace the time limit and the starting point of this article, including for the application of article 5.1 bis; the suspension of the time limit provided for in this article applies.
The upper limit of this range, 8 working weeks, is the delivery time of Onyx Forged within the meaning of article L216-1 of the French Consumer Code. Within the range, the delivery date depends on the technical complexity of the order, the industrial constraints of our manufacturing partner and seasonality.
The time is suspended for as long as the Customer has not replied to a written request for details needed for manufacture (article 3.1), during the late payment of an instalment (article 4.5), and in the event of force majeure within the meaning of article 7.2.
Onyx Forged keeps the Customer informed of the progress of the order at each key stage of production.
5.1 bis Delivery time exceeded
If the applicable delivery time is exceeded (article 5.1, or the one that replaces it: quotation for the French overseas territories, page of a dedicated project), the Customer may require Onyx Forged to deliver within a reasonable additional period. Failing performance within that period, the Customer may terminate the contract by registered letter with acknowledgement of receipt or in writing on another durable medium, under the conditions provided for by the French Consumer Code. The sums paid are then returned to the Customer within 14 days, together with, if the order had not been transmitted to production, the fee provided for in the last paragraph of article 4.5.
5.2 Delivery areas
Delivery is free to the following areas:
- Mainland France
- French overseas departments and territories, on personalised quotation: the quotation sets the delivery time to the destination, which replaces that of article 5.1
- Switzerland
- European Union
- United Kingdom
- Norway, Iceland
- Andorra, Monaco, San Marino, Liechtenstein
For deliveries outside the areas listed above, a personalised quotation is drawn up on request.
Where delivery involves customs clearance (French overseas territories, countries outside the European Union), the import duties, import VAT and other import taxes, and the customs clearance fees charged on delivery are paid by the Customer.
5.3 Carrier and dispatch
The wheels are dispatched by a tracked premium carrier, transit insurance included. The Customer receives a tracking number as soon as the carrier takes charge of the shipment.
5.4 Receipt and inspection
The Customer must check the condition of the parcel and the conformity of the wheels on receipt. Any visible defect (transport damage, scratch, finish defect, visible lack of conformity) must be reported to Onyx Forged within 7 days of delivery, by email to contact@onyxforgedwheels.com with supporting photos.
For a business Customer, once this period has expired, apparent defects can no longer be invoked. For a consumer Customer, this period is intended only to make it easier to deal with transport damage: it does not deprive the consumer of any of the rights under the statutory guarantee of conformity and the warranty against hidden defects (article 6.4).
Article 6
Warranties
6.1 Onyx Forged commercial warranty: 5 years
Onyx Forged warrants its wheels against any manufacturing or material defect for a period of 5 years from the date of delivery.
This warranty covers:
- Manufacturing defects
- Material defects (6061-T6 aluminium)
- Structural failures not caused by abnormal use
6.2 Warranty exclusions
The warranty does not apply in the following cases:
- Damage caused by an impact, accident, collision or violent blow
- Use off the open road (circuit, track, drifting, rally) without prior written agreement
- Corrosion due to the use of de-icing salts (finish warranty limited to 2 years in this case)
- Unauthorised modifications, painting, touch-ups or third-party work after delivery
- Normal wear and tear from use
- Incorrect fitting or use of unsuitable wheel bolts or nuts
- Tyre pressure not in line with the vehicle manufacturer's recommendations
- Use with tyres unsuited to the dimensions of the wheels
6.3 Making a warranty claim
Any claim under the warranty must be sent by email to contact@onyxforgedwheels.com with:
- A precise description of the defect
- Detailed photos
- The order number
- The delivery date
Onyx Forged undertakes to reply within 48 working hours.
6.4 Statutory guarantees
Independently of the commercial warranty, the Customer benefits from the following statutory guarantees:
- Guarantee of conformity (articles L217-3 and following of the French Consumer Code)
- Warranty against hidden defects (articles 1641 to 1649 of the French Civil Code)
Article 7
Liability
7.1 Limitation of liability
With regard to a business Customer, Onyx Forged may be held liable only for direct damage resulting from a proven fault, and its liability is in any event limited to the amount of the order concerned. This limitation applies neither to a consumer or non-professional Customer, nor in the event of gross negligence or wilful misconduct, nor to personal injury.
7.2 Force majeure
Onyx Forged cannot be held liable for delays or failures to perform resulting from an event of force majeure within the meaning of article 1218 of the French Civil Code. The following may constitute force majeure, provided they have its characteristics:
- Natural disasters (earthquakes, floods, storms, major fires)
- Pandemics, epidemics, health crises
- Wars, armed conflicts, attacks, acts of terrorism
- National or sector-wide strikes (transport, customs, logistics)
- Shortages of raw materials (aluminium, metals)
- Embargoes, economic sanctions, import restrictions
- Major IT failures, cyberattacks
- Decisions of public authorities affecting production or delivery
- Any other event that is unforeseeable, irresistible and external to the parties
In the event of force majeure, the manufacturing and delivery times are automatically extended by a period equivalent to that of the event. If the event lasts beyond 6 months, either party may request termination of the contract without compensation. These provisions are without prejudice to the rights that a consumer or non-professional Customer holds under articles L216-6 and L216-7 of the French Consumer Code.
Article 8
